What can even be infringing here. Almost nothing on this site comes from users. The one exception is the avatar image a player may upload, which is shown to the handful of people at that table and deleted when the table is torn down, usually within about 90 seconds of the last player leaving. There is no library, no gallery, no search, and no way to browse other people's uploads.

Email is the fastest route and the one we monitor. Notices sent anywhere else on the site may not reach the agent.

Reporting infringement

To be effective under 17 U.S.C. 512(c)(3), your notice must be a written communication that includes substantially all of the following:

  1. A physical or electronic signature of a person authorised to act on behalf of the owner of the exclusive right allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by a single notice.
  3. Identification of the material claimed to be infringing and information reasonably sufficient for us to locate it. Include the table code. Without it we very likely cannot find the material at all, for the reason in the box above.
  4. Information reasonably sufficient for us to contact you: name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner.

Act quickly, and understand why. Tables are ephemeral. A table is torn down about 90 seconds after the last player leaves, and an idle one is reclaimed after about two hours. Teardown deletes its storage outright, with no archive and no backup. If you report material after the table has ended, it is already gone, and there is nothing left for us to remove, preserve, or produce. This is a property of how the site is built, not a refusal to help.

What we do when we receive a notice

On receiving a notice that substantially complies with the requirements above, we will act expeditiously to remove or disable access to the material, if it still exists. Where we can identify the player who provided it and the table is still live, we will take reasonable steps to notify them and to tell them they may submit a counter-notice.

Counter-notice

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to dmca@pokernight.win. To be effective under 17 U.S.C. 512(g)(3) it must include substantially all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled, and the location at which it appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided the original notice or an agent of that person.

If we receive a valid counter-notice we will forward it to the original complainant and tell them we may restore the material in 10 to 14 business days unless they notify us that they have filed an action seeking a court order to restrain the allegedly infringing activity. In practice, restoration is usually impossible here because the table and its contents no longer exist.

Misrepresentation cuts both ways

Under 17 U.S.C. 512(f), a person who knowingly materially misrepresents that material is infringing, or that it was removed or disabled by mistake, may be liable for damages, including costs and legal fees. Please do not send a notice about material you do not hold the rights to, and consider whether a use is fair use before sending one.

Repeat infringers

We terminate access for anyone who repeatedly infringes the copyrights of others. There are no accounts on this site, so termination means blocking access rather than closing a profile. We keep a record of complaints we receive so that repetition can be recognised, even though the underlying material itself is not retained.

Other people's work that we use

Some assets on the site are the work of others, used under their licences, including card-back artwork and sound effects. Those attributions and licences are published at card-back credits and sound credits. If you believe something there is misattributed or used outside its licence, tell us and we will correct it.
